Meh, I don't know. Either of these looks ok to me. (Hard to tell from photos, really, maybe I would say otherwise if I was that rider in the last one.)
The rear-view mirror is EXACTLY the reason why you want more clearance when the motor vehicle passes.
Both the UT/TxDOT and UNC/Florida DOT studies arrived at the same finding. Bike lanes result in vehicles passing closer to cyclists than on wide outside lanes... which is just one of the reasons why w.o.l.s are better for cyclists.

There should be another lane for the cyclists by which the cycle ride will become safer from the fear of accident.

Those photos are great! I also love WCC's "Crap Cycle Lanes" book.
I think my favorite term "Psychling Farcilities" may have originated with them.
Cyclists here are far too tolerant of substandard garbage - from bike lanes to trail design.

Ultimately, in either situation you are relying on drivers to act in a reasonable, responsible manner. All it takes is one inattentive driver to hit you with a side mirror and end your life.
